Iowa firm sues India company over patent

Kemin Health, a part of Des Moines-based Kemin Industries Inc., has filed a patent infringement suit against OmniActive Health Technologies Inc.over its purification of lutein and lutein compositions. Kemin filed suit against OmniActive July 17 at the U.S. District Court for the Middle District of Florida, All Decision News Media reported. Kemin won a patent infringement lawsuit three years ago in a Des Moines trial.

Lutein cannot be made by the body. It helps protect eyes by acting as a filter against harmful blue light, which damages tissue of the retina. The patent that is the focus of this legal dispute involves the isolation and purification of marigold oleoresin. The resulting product is sold as FloraGlo.
