The U.S. Securities and Exchange Commission (SEC) issued a final rule Thursday that redefines indexed annuities as securities rather than as insurance products that are subject to state regulation. The rule, which was strongly opposed by several major Iowa-based issuers of these fixed annuity products, will mean that agents selling the products will need to be registered with the SEC and will be subject to securities regulations. The rule will apply to annuity contracts sold after Jan. 11, 2011. Approximately one-third of all equity indexed annuities in the United States are sold by insurers with major annuity operations in Iowa, among them Aviva USA, which is the No. 1 seller of equity indexed annuities, with $1.2 billion in annual sales.
