Myers investor has no claim in bankruptcy case, judge rules

A federal judge has dismissed a challenge to the $180 million bankruptcy filing of former Regency companies principal James Myers. Judge Lee Jackwig dismissed the case, which was brought last year by former investment partners, at the request of Myers’ attorney, Steven Wandro. Steven and Gayle Nichols and their trust accused Myers of failing to account for a $1.5 million loan to an investment company in which he had an interest. Their filing sought to stop Myers from having the debt discharged along with other business debts. Wandro argued that the Nichols received financial records explaining how the money was used. The Nichols said in their court filing that they were owed $874,202 on the loan. Myers filed for protection under Chapter 7 of federal bankruptcy laws in October 2009, slightly more than a year after Regency development companies went out of business in the face of mounting debts and declining cash flow.
