TPI Composites wants overtime lawsuit dismissed

TPI Composites Inc. wants a lawsuit claiming that it violated state wage laws dismissed because it does not directly employ three people who claim they were not paid for working overtime hours.

The Scottsdale, Ariz., company said in a motion filed May 25 in U.S. District Court in Des Moines that it is a holding company and does not directly employ anyone working at its wind turbine blade manufacturing plant in Newton.

Three former employees at the manufacturing plant, which operates under the name TPI Iowa, according to the company’s website, filed a lawsuit in Jasper County District Court accusing TPI Composites of forcing them to work overtime and failing to pay them for the extra hours they worked. TPI Iowa LLC is registered as a Delaware corporation in Iowa secretary of state records. TPI Composites Inc. is not registered with the state.

One former worker said he was fired after complaining. The lawsuit was filed by Norman Davis, April Ann Wilcox and Gary Motarie. TPI Composites filed a motion May 19 to move the case to federal court.

Davis said in the lawsuit that he complained to the company on March 18 and was fired March 24.

The lawsuit also seeks class-action status.

TPI Composites also argued in its motion to dismiss that the plaintiffs made “vague” allegations that could not be supported by facts.
