Farrell’s no longer exercised by fitness competitor
Farrell’s eXtreme Bodyshaping Inc. has dropped a federal trademark infringement lawsuit against the owners of the Kosama fitness centers.
The lawsuit alleged that Kosama directed viewers to its websites by using Internet search keywords associated with Farrell’s.
Both companies are growing as fitness centers and franchise operations. The lawsuit pointed out that both companies offer similar services.
Attorneys for Farrell’s and Kosama could not be reached for comment about why the lawsuit was dismissed. Nearly 95 percent of trademark infringement lawsuits are settled before the cases reach trial, according to legal experts.
