Mediacom Communications Corp. is asking the Federal Communications Commission to review “discriminatory rights-of-way management practices” by the city of West Des Moines regarding the city’s conduit project with Google Fiber. Mediacom filed a lawsuit against the city and the West Des Moines City Council over the project in December 2020. In the new filing, Mediacom subsidiary MCC Iowa LLC requested that the FCC direct the city of West Des Moines to pause the city’s construction schedule of the conduit, reform its conduit contract with Google Fiber, and either prove to the FCC that the conduit network’s design is provider-neutral or be required to reform the conduit network’s design under guidance from a third-party expert, which Mediacom asked be chosen by a majority of West Des Moines-based internet service providers. In its ongoing lawsuit, Mediacom alleges that the city is improperly financing the nearly $50 million project and that it offers a competitive edge to Google Fiber by granting it exclusive rights to use for 18 months.
