Three landowners sue Iowa Utilities Board over Bakken pipeline
Three Iowa landowners have sued the Iowa Utilities Board, contending Dakota Access should not be allowed to use eminent domain to get access to land for a planned 1,134-mile Bakken oil pipeline that would run through South Dakota, Iowa and Illinois. The plaintiffs are Brent Jesse, Verdell Johnson and Richard Lamb. They argue that the utilities board doesn’t have the authority to grant eminent domain rights in the situation. Bill Hanigan of Davis Brown Law Firm and Richard A. Cook of Herrick, Ary, Cook, Cook, Cook & Cook are representing the plaintiffs. Proponents say the proposed pipeline would generate significant economic benefits for Iowa while it’s being built, according to the results of a study released in November 2014.
